Trust Litigation includes Probate Litigation because these cases are tried in Probate Court. They frequently involve disputes about validity of documents, sufficient mental capacity to create an estate plan, elder abuse, undue influence, Trustee wrongdoing, funding, accounting, and creditor claims. While Trusts provide an option to avoid judicial oversight of Trust Administration, the Probate Court is available if problems arise. In many cases, once the problem is solved, the Probate Court will permit Trust Administration to be completed outside of Probate, without further Probate Court oversight.
